Will review the necessity for continuing the order of curfew in 30 days,
RESOLUTION NO. 77-2020
Upon a motion by Representative Pemberton, and a second by Secretary Strong, the following was enacted:
WHEREAS, the Red Lake Tribal Council is the governing body of the Red Lake Band of Chippewa Indians; and the Tribal Council has the constitutional authority and the responsibility to provide for the safety, health and welfare of its members; and
WHEREAS, the Tribal Council has been closely monitoring the progression of the COVID-19 virus and the impacts of the virus; the threats to public safety that the virus presents to the Red Lake Nation; and the guidance that has been regularly provided through the Indian Health Service, the Center for Disease Control, Minnesota Governor Walz, and other tribal, federal and state authorities; and
WHEREAS, the Tribal Council has been working continuously to determine the risks to Red Lake Band members presented by the COVID-19 pandemic, and the steps that are necessary to safeguard the health and safety of Band members; and
WHEREAS, the Tribal Council has determined that in order to protect Band members from the increasingly more serious threat from the COVID-19 virus, that it is necessary at this time to impose a curfew on Band members who live on the Red Lake Reservation. Now
THEREFORE BE IT RESOLVED, that the Tribal Council hereby orders that a curfew shall be in effect for all persons on the Red Lake Reservation from 10:00 pm to 6:00 am beginning immediately on March 23, 2020, and continuing until further order of the Tribal Council; and
BE IT FURTHER RESOLVED, the Tribal Council hereby provides that there are exceptions to the curfew for those persons who are going to and from their employment and/or medical purposes; and
BE IT FURTHER RESOLVED, the Tribal Council hereby orders that the penalty for violating the present curfew shall be a citation issued by the Red Lake Police Department; and
BE IT FINALLY RESOLVED, the Tribal Council shall review the necessity for continuing the order of curfew in 30 days, and at each 30 day interval thereafter if the Tribal Council determines that the curfew should be continued.
