PRIMARY FUNCTION:

An Appellate Judge is nominated by the Tribal Chairman and ratified by a vote of the Tribal Council. An Associate Judge serves as an official of the Judicial Branch of the Red Lake Band of Chippewa Indians. Appellate Judge conducts appeal hearings from trial court, issues court orders, reviews trial decisions, renders conclusions of law, and develops precedent. As needed. Salary: $150.00 per day.

ESSENTIAL RESPONSIBILITIES AND DUTIES:

• Exercises independent professional judgment in deciding cases and controversies including but not limited to jurisdiction of the court and applicable tribal law and procedure.

• Adheres to the Revised Constitution, tribal law (statutory or common law), and rules of practice.

• Administer oaths and affirmations; and to discharge the duties and exercise the authority conferred by law.

• Maintains proper continuing legal education with specific focus on developments affecting Indian Country.

• Possesses sufficient communication skills, specifically oral communication sufficient to handle tense and difficult situations and at times issue oral court orders.

• Observe and maintain high standards of conduct so that the integrity of the Tribal Court will be preserved.

• Demonstrate patience, dignity and courtesy.

• Accord each party the right to be heard in accordance with the law.

• Dispose of all judicial matters promptly, efficiently, and fairly.

EDUCATION/WORK EXPERIENCE/QUALIFICATIONS:

• Shall be a Tribal Member and shall have reached the chronological age of fifty-five (55) years.

• Shall have graduated from high school or obtained an equivalent degree;

• Shall be knowledgeable about the Revised Constitution and Bylaws of the Red Lake Band of Chippewa Indians and the unwritten customs and traditions of the Band; and

• Experience or willingness to gain experience in the Red Lake Tribal Code, federal statutes, and regulations that affect tribal law and jurisdiction.

• Ability to analyze legal issues, principles and doctrines in order to decide cases and controversies.

• Shall maintain confidentiality.

• Shall be a person of honor and integrity and good moral character as evidenced by letters of recommendation from four (4) elders of the Band who are not related within the first degree to the person nominated for the position of Justice or Chief Justice.

• Ability to work cordially and effectively with staff and public.

• Must never been convicted of a felony or if that person shall have been convicted of a lesser offense involving moral turpitude.

• Submit to and pass a pre-employment background check and random drug/alcohol screening.

• Must have personal conduct standards that demonstrate the highest degree of ethics and morality.

• Preference: All applicants are considered without regard to sex, race, national origin, religion, marital status, or physical disability. However, preference will be given to qualified band members, to qualified persons of American Indian descent, then to qualified candidates in accordance with PL. 88-355, sec. 703 (702-71) and PL. 93-638, sec. 7B.
