Nebraska asks judge to toss suit over Winnebago Reservation cigarette sales

Cigarette sales on the Winnebago Indian Reservation can still be regulated in some ways, even though tribal reservations are considered sovereign territory, attorneys for the state of Nebraska argued Monday in federal district court in Omaha.

Assistant Attorney General Daniel Muelleman said the two companies that manufacture and distribute the cigarettes on the Winnebago's territory aren't actually part of tribe. As such, they can be required to put money into an escrow account to cover revenue shortfalls.
