Gavel to Gavel: Tribal sovereign immunity and real property lawsuits

What began as a garden-variety boundary dispute between adjacent landowners in rural Washington state may have far-reaching effects for Native American tribes.

The case, Upper Skagit Indian Tribe v. Lundgren, involves the sovereign immunity of tribes from lawsuits relating to land, known as in rem proceedings. The case is now before the U.S. Supreme Court, which will decide if tribal sovereign immunity applies to such suits.
