Prosecutors rebut dismissing Yanez charges saying evidence is substantial in police shooting

ST. PAUL -- Prosecutors have enough evidence to charge the St. Anthony police officer who fatally shot Philando Castile with manslaughter and the suggestion by his defense that Castile somehow caused his own death through negligence is for a jury to decide.
That’s the argument laid out by Ramsey County attorneys in a 14-page legal memo filed Wednesday afternoon in Ramsey County District Court.
The memo came in response to a motion filed in December by officer Jeronimo Yanez’s defense team that argued the case should be dismissed because Castile was reportedly high on marijuana at the time of the shooting, therefore negligent in his own death.
