BEMIDJI -- A petition filed by the mother of Jacob Kinn -- a Bemidji man accused of kidnapping and sexually assault a 5-year-old girl -- asking to be appointed his guardian, was dismissed Friday by a judge, five days after Kinn’s mother herself filed a notice dismissing it.
The notice, which reads, in part, “COMES NOW petitioner, Teri Kinn, by and through her attorney, Mark Wangberg...and gives notice that the above-entitled cause of action is hereby dismissed,” was filed Oct. 31. Judge John Melbye signed the order dismissing the petition Friday.
A petitioner is allowed to dismiss a petition at any time as long as the other party has not responded.
