Redby man sentenced to seven years for burglary, assault

BEMIDJI -- A Redby man was convicted Tuesday in Beltrami County Court on felony charges for stabbing a man in May.

Orland James Spears, 23, was sentenced to more than five years (69 months) in the Minnesota Correctional Facility in St. Cloud for first-degree burglary. He has been credited with 96 days time served and must pay a $50 fine. Spears was also sentenced consecutively to 21 months in prison for a second-degree assault charge. A $50 fine accompanies that charge as well.

Spears plead guilty in June to stabbing a man at the man’s home on Averi Circle NW in Beltrami County. Spears asked to use the man’s telephone which the man allowed. The victim refused to jumpstart Spears’ car, which turned out to be a stolen van from Red Lake. It was at that time Spears pushed the door open and stabbed the man twice in the chest, according to a criminal complaint. Spears fled on foot and was later apprehended by the Beltrami County Sheriff’s Office K-9.

The maximum penalty for first degree-burglary is 20 years in prison and a $35,000 fine. Second-degree assault carries a maximum sentence of seven years in prison and a $14,000 fine.
