New revisions to the Red Lake Sexual Offender Registration Code

June 20, 2012 - The Red Lake Department of Public Safety would like to announce some new revisions regarding the Sexual Offender Registration Code. The Red Lake Tribal Council recently approved revisions to Tribal Code Section 411.02 regarding the registration of Sex Offenders. The revisions now include a classification system for registered offenders residing within the exterior boundaries of the reservation by using a Tier System. Offenders will now be classified using the new Tier system based upon a previous conviction of tribal, federal or state law. The code is maintaining consistency with the Adam Walsh Act and all offenders shall maintain registration requirements with the Red Lake Department of Public Safety Sexual Offender Registration Offices.

The new Tier System includes three different levels of distinction and mandates registration requirements as followed and described for Tier 1, 2 and 3 level sexual offenders.

Tier 1 includes convictions for all sexually related crimes in any jurisdiction resulting in a one year sentence or less upon conviction and also includes any civil commitments surrounding an incident which was sexual in nature. Tier 1 registration requires convicted offenders to register up to a period of 15 years from the date of their conviction. In addition, Tier 1 offenders are also required to update their registration on a yearly annual basis.

Tier 2 level includes sexually related crimes in any jurisdiction resulting in more than a one year sentence upon conviction. Tier 2 offenders shall be required to register up to a period of 25 years from the date of their conviction. Tier 2 offenders are required to update their registration information every 6 months.

Tier 3 includes convictions for all felony and gross misdemeanor crimes in any jurisdiction which were sexual in nature and involved force or coercion or aggravated crimes, or which there were two or more convictions for a sexually related crime, or crimes involving children under 12. Tier 3 registration periods shall be lifetime from date of conviction. Tier 3 offenders are required to update their registration every 3 months.

Tribe and Territory Sex Offender Information System (TTSORS)

TTSORS is a public website administered by Red Lake Department of Public Safety for information on sex offenders registered in Red Lake.

TTSORS is provided by Department of Justice for tribes working to implement Adam Walsh Act/SORNA.

This website will be available to the public by July 27, 2012. Tier 2 and Tier 3 offenders will be viewable on this website. Sex Offender informational kiosks will also be available to the public at the Red Lake Criminal Justice Complex and Ponemah Sub Station.
