Assistant Attorney General Lanny A. Breuer of the Justice Department's Criminal Division and U.S. Attorney Kenneth J. Gonzales for the District of New Mexico delivered the keynote remarks at the Third Annual Gangs, Drugs & Prosecution Conference in Belen, N.M., on Thursday, June 22, 2011. The conference was hosted by the 13th Judicial District Attorney's Office for the State of New Mexico. While in New Mexico, both attended the graduation ceremony at "Camp Triumph," a summer youth camp sponsored by the U.S. Attorney's Office for the District of New Mexico and other law enforcement partners, which plays a vital role in keeping New Mexico youth safe from drug, gang and gun violence. Assistant Attorney General Breuer and U.S. Attorney Gonzales, together with Governor Richard Luarkie of the Pueblo of Laguna, also participated in a ceremony to sign a Memorandum of Understanding between the Pueblo of Laguna and the U.S. Attorney's Office, highlighting their shared commitment to responding to the serious problem of violence against Native women.

Anadarko and Kerr-McGee to Pay More Than $17 Million to Resolve Allegations of Royalty Underpayments from Federal and Indian Lands (U.S. Attorney for the Eastern District of Texas)
U.S. Attorney John Malcolm Bales announced on June 20, 2011, that Anadarko Petroleum Corporation, Kerr-McGee Corporation and their affiliates have agreed to pay the United States more than $17 million to resolve claims that the companies violated the False Claims Act by knowingly underpaying royalties owed on natural gas produced from federal and Indian leases, and numerous additional administrative claims. Anadarko is among the largest independent oil and natural gas exploration and production companies in the world. Anadarko and Kerr-McGee were independent companies and were separately sued when this case was originally filed in 1996. Total settlements in the case to date exceed $249 million.

Supreme Court Denies Request by South Dakota and Charles Mix County to Hear Yankton Sioux Reservation Case (U.S. Attorney for the District of South Dakota)
U.S. Attorney Brendan V. Johnson announced on June 20, 2011, that the U.S. Supreme Court has denied a request by the State of South Dakota, Charles Mix County and Southern Missouri Waste Management District to hear arguments concerning whether the Yankton Sioux Indian Reservation has been disestablished. The three claimed the Reservation was terminated by an 1894 federal statute which approved an agreement between the Yankton Sioux Tribe and the United States allowing for the sale of some, but not all, tribal lands to the federal government. The United States and the Yankton Sioux Tribe opposed the request for Supreme Court review and argued that their agreement had not disestablished the Reservation.

New Mexico Man Pleads Guilty to Aggravated Child Sexual Abuse (U.S. Attorney for the District of New Mexico)
U.S. Attorney Kenneth J. Gonzales announced on June 17, 2011, in federal court in Albuquerque, N.M., Michael Crosby, 54, entered a guilty plea to aggravated sexual abuse of a child who had not attained the age of 16 years. Under the terms of his plea agreement, Crosby will be sentenced to 12 to 14 years in prison to be followed by at least five years of supervised release. Crosby also will be required to register as a sex offender after completing his prison sentence.

North Dakota Man, Pleads Guilty to Assault with a Dangerous Weapon (U.S. Attorney for the District of North Dakota)
U.S. Attorney Timothy Q. Purdon announced on June 20, 2011, that Elmer Flying Horse, 25, of N.D., pleaded guilty to a charge of assault with a dangerous weapon in U.S. District Court. The charge of assault with a dangerous weapon carries a statutory maximum penalty of 10 years in prison and a $250,000 fine.
New Mexico Pueblo Woman Pleads Guilty to Federal Bank Robbery (U.S. Attorney for the District of New Mexico)
U.S. Attorney Kenneth J. Gonzales announced on June 20, 2011, Adriana Nicole Abeita, 24, entered a guilty plea to an information charging her with bank robbery. At sentencing, Abeita faces a maximum penalty of 20 years in prison, a $250,000 fine and three years of supervised release.
Oklahoma Man Sentenced to Five Years Probation for Embezzlement and Theft (U.S. Attorney for the District of Oklahoma)
U.S. Attorney Thomas Scott Woodward announced on June 20, 2011, that Kevin Ray Bond, 43, Okla., was sentenced to five years probation for embezzlement and theft from an Indian Tribal Organization. Restitution was ordered in the amount of $14,800.

South Dakota Mission Man Sentenced on Assault Charge (U.S. Attorney for the District of South Dakota)
U.S. Attorney Brendan V. Johnson announced that a Mission, S.D. man charged with assault resulting in serious bodily injury was sentenced on June 20, 2011, by U.S. District Judge Roberto A. Lange. Benjamin Wayne Kitteaux, 23, was sentenced to 46 months in prison, $756.31 restitution, and two years of supervised release. Kitteaux was indicted by a federal grand jury in December 2010. He pleaded guilty to one count of the indictment in March 2011.

South Dakota Woman Pleads Guilty to Methamphetamine Charges (U.S. Attorney for the District of South Dakota)
U.S. Attorney Brendan V. Johnson announced on June 20, 2011, that Arlene Siers, 23, appeared before U.S. District Judge Roberto A. Lange on June 20, 2011, and pleaded guilty to an indictment that charged her with conspiracy to possess with intent to distribute a controlled substance. If convicted she faces the possible maximum penalty of 20 years in prison, a $1 million fine, or both; three years of supervised release; and a $100 special assessment. Siers was a middle woman for two individuals and assisted them in distributing methamphetamine on the Rosebud Reservation. A sentencing date was set for September 16, 2011.

Arizona Man Sentenced to 84 Months for Selling Crack Cocaine in Gila River Indian Community (U.S. Attorney for the District of Arizona)
U.S. Attorney Dennis K. Burke announced on June 21, 2011, that Willard Jeffrey Pratt, 30, of Sacaton, Ariz., and a member of the Gila River Indian Community, was sentenced by Chief U.S. District Judge Roslyn O. Silver to 84 months in federal prison for conspiring to possess cocaine base with the intent to distribute and possession of cocaine base with the intent to distribute in October 2009.

New Mexico Pueblo Man Pleads Guilty to Federal Child Sexual Abuse Offense (U.S. Attorney for the District of New Mexico)
U.S. Attorney Kenneth J. Gonzales announced on June 21, 2011, that in federal court in Albuquerque, N.M., Steven Henry Sisneros, 27, entered a guilty plea to an indictment charging him with sexual abuse of a minor. At sentencing, Sisneros faces up to 15 years in prison, a maximum $250,000 fine and a minimum five-year term of supervised release. Sisneros also will be required to register as a sex offender. Sisneros has been in federal custody since his arrest on March 26, 2011.

U.S. Attorney Brendan V. Johnson announced on June 21, 2011, that Tristan Yellow Horse, 25, of Oglala, S.D., appeared before U.S. District Judge Jeffrey L. Viken on June 16, 2011, and pleaded guilty to a charge of assault resulting in serious bodily injury. The maximum penalty upon conviction is 10 years in prison and/or a $250,000 fine. In November 2010, near Oglala, Yellow Horse helped assault another man by kicking him in the head and punching him in the face, causing nasal and rib fractures.

Minnesota Man Indicted for Involuntary Manslaughter (U.S. Attorney for the District of Minnesota)
U.S. Attorney B. Todd Jones announced June 21, 2011, that Kyle Mitchell Hardy, a 20-year-old Red Lake, S.D., man, was indicted in connection with the death of a teenage girl following an automobile crash that occurred between Redby and Ponemah on Aug. 28, 2009. If convicted, Hardy faces a potential maximum penalty of eight years in federal prison on each count.
South Dakota Man Sentenced for Sexual Abuse of a Minor (U.S. Attorney for the District of South Dakota)
U.S. Attorney Brendan V. Johnson announced that, Wilbur Toledo Flute, an Oglala, S.D., resident, charged with sexual abuse of a minor was sentenced on June 20, 2011, by U.S. District Judge Jeffrey L. Viken. Flute, 37, was sentenced to 18 months in prison, five years of supervised release, and a $100 victim assessment. He pleaded guilty on April 1, 2011.

U.S. Attorney Brendan V. Johnson announced on June 21, 2011, that Kristen Traversie, 20, appeared before U.S. District Judge Rogerto A. Lange and pleaded guilty to bank embezzlement. The maximum penalty upon conviction is 30 years in prison, a $1 million fine, or both; five years of supervised release; and a special assessment of $100 to the Victim Assistance Fund. Between Jan. 3, 2011, and Feb. 23, 2011, Traversie intentionally defrauded Wells Fargo Bank by embezzling and misapplying more than $1,000 in customer's deposits and funds entrusted to the care of Wells Fargo Bank.

Lange on June 21, 2011 and pleaded guilty to an indictment charging him with conspiracy to distribute and possess with intent to distribute Vicoprofen (a combination Hydrocodone product), a Schedule III controlled substance. If convicted, Brown Wolf could face the maximum penalty 10 years in prison, a $500,000 fine, or both; up to life of supervised release; and a $100 special assessment. A sentencing date was set for Sept. 6, 2011.

South Dakota Man Pleads Guilty to Assaulting a Federal Officer (U.S. Attorney for the District of South Dakota)
U.S. Attorney Brendan V. Johnson announced on June 21, 2011, that John Denoyer, 29, appeared before U.S. District Judge Roberto A. Lange and pleaded guilty to a charge of assaulting a federal officer. If convicted, he faces a possible maximum penalty of eight years in prison. In September 2009, Denoyer and his wife were involved in a domestic violence incident at their home in Todd County, S.D., in which law enforcement was called and arrived on the scene. Officer Anthony Long Soldier was allegedly assaulted following an attempt to arrest the defendant. A sentencing date was set for Sept. 7, 2011.

Former General Manager of Chukchansi Gold Resort & Casino Convicted of Defrauding Casino (U.S. Attorney for the Eastern District of California)
U.S. Attorney Benjamin B. Wagner announced on June 21, 2011, that Jeff Livingston, 51, of Las Vegas, was convicted of six counts of mail fraud and three counts of theft by an officer or employee of an Indian gaming establishment, stemming from his embezzlement and theft of money and property from the Chukchansi Gold Resort and Casino. The guilty verdict was returned on all counts by a federal jury in Fresno, Calif., after a five-day trial before U.S. District Judge Lawrence J. O'Neill. The evidence at trial showed that Livingston, Chukchansi's general manger, executed a scheme to defraud Chukchansi by making a series of personal purchases using his business credit card and other Chukchansi funds. Chukchansi Gold Resort and Casino is owned and operated by the Picayune Rancheria of Chukchansi Indians, a federally recognized Indian tribe in Madera County. Livingston is scheduled to be sentenced on Sept. 2, 2011. He faces a maximum sentence of 20 years in prison and a $1 million fine.

Lange on June 21, 2011, and pleaded guilty to a superseding information charge with misprision of a felony. If convicted, the maximum penalty is three years in custody, a $250,000 fine, or both; one year of supervised release; and a $100 special assessment. The investigation was conducted by the FBI and the Cheyenne River Sioux Tribe Law Enforcement Division. A sentencing date was set for Sept. 6, 2011.

U.S. Attorney Brendan V. Johnson announced on June 22, 2011 that Wayne C. Richards, 19, of Rapid City, S.D., charged with possession of a stolen firearm, was sentenced on June 20, 2011, by U.S. District Judge Roberto A. Lange. Richards was sentenced to 51 months in prison, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund. Richards was indicted by a federal grand jury on Jan. 19, 2011 after knowingly possessing a stolen Smith & Wesson Model 649, .357 magnum caliber revolver. Richards pleaded guilty to the charge on March 28, 2011.

Red Bird was sentenced to 40 months in prison, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund. Red Bird was indicted when he unlawfully assaulted two victims with a dangerous weapon.

North Dakota Man Pleads Guilty to Sexual Abuse of a Minor (U.S. Attorney for the District of North Dakota)
U.S. Attorney Timothy Q. Purdon announced on June 22, 2011, that Gerald Roubideaux, 20, of Cannon Ball, N.D., pleaded guilty in U.S. District Court to a charge of sexual abuse of a minor. Roubideaux admitted to engaging in a sexual act with a juvenile sometime in July 2009 in Cannon Ball, N.D. The charge of sexual abuse of a minor carries a maximum penalty of 15 years in federal prison and a $250,000 fine. Sentencing for Roubideaux has been scheduled for Sept. 19, 2011.

Wyoming Man Sentenced for Involuntary Manslaughter (U.S. Attorney for the District of Wyoming)
U.S. Attorney Christopher A. Crofts announced on June 23, 2011, that Lynn McAdams of Fort Washakie, Wyo., on the Wind River Indian Reservation, appeared in federal court after having pleaded guilty to one count of involuntary manslaughter in connection with an alcohol-related traffic fatality occurring in October 2006. McAdams was sentenced on June 13, 2011, by Federal District Court Judge Alan B. Johnson to two years probation with nine months of home confinement. He was also ordered to complete a substance abuse treatment program.

Wyoming Woman Sentenced for Criminally Negligent Homicide (U.S. Attorney for the District of Wyoming)
U.S. Attorney Christopher A. Crofts announced on June 23, 2011, that Jamie Chippewa, 25, of the Wind River Reservation, an enrolled Chippewa-Cree tribal member, was sentenced by Federal Magistrate Judge Richard G. Gist for criminally negligent homicide stemming from a two-vehicle crash on June 30, 2009. Chippewa was sentenced to two years of supervised probation with the first six months of her probation served in home confinement through the location monitoring program. Chippewa was ordered to pay restitution in the amount of $19,216.72 and a $25.00 special assessment. This case was investigated by the Wind River Police Department and the FBI.

Gonzalez announced during a federal court session on June 15, 2011, in Albuquerque, N.M., that Matthew Archie Johnson, a 25-year-old enrolled member of the Navajo Nation, entered a guilty plea to an assault resulting in serious bodily injury offense. At sentencing, Johnson faces a maximum penalty of 10 years in prison and three years of supervised release. A sentencing date has not yet been scheduled.

Wisconsin Man Charged with Aggravated Assault on the Menominee Indian Reservation (U.S. Attorney for the Eastern District of Wisconsin)
U.S. Attorney James L. Santelle announced on June 15, 2011 that a federal grand jury returned a three-count indictment against Clifton Kaquatosh, 30, charging him with assault with a dangerous weapon, assault resulting in serious bodily injury and theft occurring on the Menominee Indian Reservation. If convicted, Santelle faces a maximum penalty of up to 10 years in prison and/or a $250,000 fine for the assault offenses, and up to five years in prison and/or a $250,000 fine for the theft offense.

Wisconsin Man Charged With Sexual Assault On The Menominee Indian Reservation (U.S. Attorney for the Eastern District of Wisconsin)
U.S. Attorney James L. Santelle announced during a federal court session on June 15, 2011 that a federal grand jury returned a two-count indictment against Darrell M. Schneider, 29, of Keshena, Wis., charging him with engaging in a sexual act with an individual incapable of appraising the nature of the conduct. According to a criminal complaint filed in the case in April 2011, Schneider supplied alcohol to a 15 year old victim. The complaint alleges that after she passed out, she awoke to find Schneider on top of her attempting to commit a sexual act. Each count has a maximum penalty of up to life in prison and/or a $250,000 fine.

Idaho Woman Pleads Guilty to Involuntary Manslaughter (U.S. Attorney for the District of Idaho)
U.S. Attorney Wendy J. Olson announced on June 14, 2011, that Andrea George, 19, of De Smet, Idaho, pleaded guilty in federal court in Coeur d'Alene, Idaho, to involuntary manslaughter. According to the indictment, on April 19, 2010, George was speeding when she struck and killed a pedestrian who was standing in the roadway. George was found to be under the influence of alcohol at the time. If convicted, she faces a maximum penalty of up to eight years in prison, a fine up to $250,000 and up to three years of supervised release. Sentencing is scheduled for Sept. 7, 2011.

U.S. Attorney Wendy J. Olson announced on June 15, 2011 that Joseph Michael Matt Jr., 26, of Worley, Idaho, was sentenced to 36 months in federal prison followed by three years of supervised release for involuntary manslaughter. Matt appeared before U.S. District Judge Edward J. Lodge. Judge Lodge also ordered Matt to pay $5,707.66 in funeral expenses for the victim. He pleaded guilty to the charge on Nov. 22, 2010. The case was investigated by Coeur d'Alene, Idaho, Tribal Police, the Idaho State Police and the FBI.

U.S. Attorney Brendan Johnson announced on June 15, 2011 that Shirley White Buffalo, 64, was sentenced on June 13, 2011, by U.S. District Judge Charles B. Kornmann. White Buffalo was sentenced to three years of probation and $100 to the Victim Assistance Fund. White Buffalo pleaded guilty to concealing and destroying a document on Feb. 28, 2011.

Campbell, that Charles Tsosie Ashley, 62, of Wide Ruins, Ariz., was sentenced to 78 months in prison for abusive sexual contact with a minor. Idaho Man Pleads Guilty to Stealing from Nez Pearce Express (U.S. Attorney for the District of Idaho)
U.S. Attorney Wendy J. Olson announced during a federal court session on June 16, 2011 before U.S. District Judge Edward J. Lodge, that Michael Charles Taylor, 39, of Lapwai, Idaho, pleaded guilty to grand theft. Taylor stole $8,146.88 from the Nez Perce Tribal Express store where he was employed as a cashier. Taylor agreed to pay the store $9,146.88 in restitution. If convicted, Taylor faces possible penalties of up to 14 years in prison, a $250,000 fine and up to three years of supervised release. Sentencing is scheduled for Sept. 7, 2011.

Oklahoma Man Pleads Guilty to Second Degree Murder (U.S. Attorney for the District of Oklahoma)
U.S. Attorney Thomas Scott Woodward announced that Steven Thompson Keeling, a non-Indian from Hominy, Okla., pleaded guilty to second degree murder during a federal court session on June 16, 2011. Keeling admitted he shot and killed Edward Brown, a citizen of the Muscogee Creek Nation on Jan. 17, 2011. Sentencing has been set for Sept. 15, 2011. Keeling will be sentenced to 25 years in prison. Keeling is also charged in Tulsa County, Okla., with shooting with intent to kill another alleged victim as a result of the same event. This allegation is in Tulsa County District Court based upon that alleged victims status as a non-Indian.

New Mexico Man Sentenced to 84 Months in Prison For Federal Firearms Conviction (U.S. Attorney for the District of New Mexico)
U.S. Attorney Kenneth J. Gonzales announced on June 17, 2011, during a federal court session in Santa Fe, N.M., that Leonardo Valentino Gonzales, 35, of Dulce, N.M., was sentenced in connection with his conviction for being a felon in possession of a firearm and ammunition. Gonzales was sentenced to 84 months in prison and two years supervised released.

New Mexico Man Sentenced to 24 Months in Prison For Federal Assault Conviction (U.S. Attorney for the District of New Mexico)
U.S. Attorney Kenneth J. Gonzalez announced on June 17, 2011, during a federal court session in Santa Fe, N.M., that Calbert Henderson, a 29-year-old enrolled member of the Navajo Nation, was sentenced to 24 months in prison and two years of supervised release based on his assault with a dangerous weapon conviction. Henderson pleaded guilty to a criminal information charging him with assaulting two individuals with a dangerous weapon on Aug. 10, 2010.

Washington Man Sentenced to 87 Months in Prison for Sexual Abuse of A Minor (U.S. Attorney for the Western District of Washington)
U.S. Attorney Jenny A. Durkan announced during a federal court session on June 17, 2011, before U.S. District Judge Robert J. Bryan, that Louis Hunter Bennett, 33, of the Lower Elwha Tribe was sentenced to 87 months in prison and a lifetime of supervised release for three counts of sexual abuse of a minor. According to the plea agreement signed in March 2011, Bennett engaged in sex acts with a minor, who is under the age of 16, on three occasions in 2009 and 2010.
