Red Lake, Minn., man charged in teenage girl's 2009 death

A 20-year-old Red Lake, Minn., man has been indicted in federal court in connection with the death of a teenage girl after an car crash in August 2009.

The indictment charges Kyle Mitchell Lee Hardy with three counts of involuntary manslaughter for the crash that happened between two towns on the shores of Lower Red Lake, Redby and Ponemah, on the Red Lake Indian Reservation.

Hardy made his initial appearance on Monday in federal court in Duluth, according to a press release from the U.S. Attorney’s Office in Minnesota.

The indictment alleges that on Aug. 28, 2009, Hardy, who was drinking while under age, killed the girl without malice while driving recklessly and under the influence. According to police reports, Hardy, then 18, was at a party in Redby when he decided at around 1 a.m. to drive a pickup truck to Ponemah. Two boys and one girl got in the back of the uncovered truck.

Hardy allegedly was driving next to another vehicle when he approached a curve in the road. His truck went off the road, crashed into a ditch, and the three passengers were ejected. The girl was killed.

If convicted, Hardy faces a potential maximum penalty of eight years in federal prison on each count.

This case is the result of an investigation by the Red Lake Tribal Police Department and the Federal Bureau of Investigation.

Because the Red Lake Indian Reservation is a federal-jurisdiction reservation, some of the crimes that occur there are investigated by the FBI in conjunction with the Red Lake Tribal Police Department. The U.S. Attorney’s Office prosecutes such cases.
